Please read these terms carefully before using Mygospay services.

Important Notice

By accessing or using Mygospay's services, you agree to be bound by these Terms. If you disagree with any part of these terms, you may not access our services.

1. Introduction

These Terms of Service ("Terms") govern your use of Mygospay's website, mobile application, and services (collectively, the "Services") operated by Mygospay ("we," "us," or "our"). These Terms outline the rules for using our platform and the services we provide to churches and their members in Ghana.

Our platform facilitates financial contributions to churches, including tithes, offerings, dues, and fundraising campaigns. By using our Services, you consent to these Terms and our Privacy Policy.

2. Eligibility

To use our Services, you must be at least 18 years old and capable of forming a binding contract. If you're using the Services on behalf of a church or organization, you represent that you have the authority to bind that entity to these Terms.

Churches using our platform must be legally established religious organizations in Ghana and comply with all applicable laws and regulations.

3. Account Creation and Security

When you create an account, you must provide accurate and complete information. You're responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

You agree to notify us immediately of any unauthorized use of your account. We reserve the right to terminate accounts that violate these Terms or for any other reason at our discretion.

Security Requirements:

  • Use strong, unique passwords
  • Enable two-factor authentication when available
  • Never share your account credentials
  • Log out from shared devices

4. Payment Processing

Our Services facilitate payments to churches through our payment processor partners, including PayStack. By using our payment services, you agree to comply with our payment processor's terms of service.

All payments are processed in Ghanaian Cedis (GHS). You're responsible for providing accurate payment information and ensuring you have sufficient funds to complete transactions.

Churches receiving funds through our platform are responsible for complying with all applicable tax and financial regulations in Ghana.

5. Fees and Charges

Mygospay charges fees for certain services as outlined on our pricing page. We reserve the right to change our fee structure with reasonable notice. Churches may choose to absorb these fees or pass them on to contributors, in accordance with our fee policy.

Payment processors may charge additional fees for payment processing. These fees are separate from Mygospay's service fees.

6. User Conduct

When using our Services, you agree not to:

  • Use the Services for any illegal or unauthorized purpose
  • Violate any laws or regulations in your jurisdiction
  • Interfere with or disrupt the Services or servers
  • Attempt to gain unauthorized access to our systems
  • Impersonate another person or entity
  • Collect user information without consent
  • Upload malicious code or content
  • Use the Services to send unsolicited communications

7. Intellectual Property

The Services and all content, features, and functionality are owned by Mygospay and are protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any materials from our Services without our written consent.

8. Third-Party Links and Services

Our Services may contain links to third-party websites or services that are not owned or controlled by Mygospay. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.

We strongly advise you to read the terms and privacy policies of any third-party websites or services that you visit or use.

9. Disclaimer of Warranties

The Services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not guarantee that the Services will be uninterrupted, secure, or error-free.

We disclaim all warranties, express or implied, including but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the maximum extent permitted by law, Mygospay shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, arising out of or relating to your use of the Services.

In no event shall our total liability to you for all claims exceed the amount you paid to Mygospay during the twelve (12) months preceding the event giving rise to the liability.

11. Indemnification

You agree to indemnify and hold harmless Mygospay and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your access to or use of the Services, your violation of these Terms, or your violation of any rights of another.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by updating the date at the top of these Terms and notifying you via email or through the Services. Your continued use of the Services after such changes constitutes your acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Ghana, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the courts located in Ghana for the resolution of any disputes.
